摘要

民事诉讼中公告送达是在受送达人下落不明,或者采用其他方式(即:直接送达,留置送达,为送达,邮寄送达,转交送达.)无法送达时所采用的一种特殊的送达方式. "公告送达"这一法律规定，有效地保护了当事人的民事权益，也使得人民法院在一方当事人下落不明的情况下，仍可以按程序正常办案，同时，也为了实现与受送达方取得联系，告之其享有的权利，承担的义务，使其合法权利得以保障的目的。民事公告送达是维护司法程序公正的主要保障,具有很高的理论价值和实践价值。
本文主要针对目前我国民事公告送达的现状进行分析，提出在实际过程中出现的问题，通过对我国民事公告送达制度进一步研究，使其与国外相关法律的进行对比，从中提取适合我国的现状相关条款，来解决这些问题，提出完善民事公告送达制度的设想。
