D were firm of merchants, owed £22,000 to the back and were asked by bank to pay security for the debt
D promised to assign to bank documents of title of certain goods as security.
Bank accepted-made no express promise not to sue
D failed to provide the security and bank sued
Held: consideration provided. Bank entitled to specific performance of the title. D had received benefit of forbearance from being sued- this would not have come about if they had not made the promise.
