The obligations of recipient under this agreement shall not apply to information which:
1, was known by recipient at the time of disclosure from a source other than Customer which was not prohibited from disclosing such confidential information to the recipient by any legal, fiduciary,or contractual obligation; or
2,was know to have been in the possession of the recipient, as established by documentary evidence,prior to being disclosed by or on behalf of Customer pursant to this agreement; or
